Client Participation Terms


1. Purpose of these Terms

These Client Participation Terms explain:

  • how SureCert is involved in background checks and verifications;
  • your role as a participant in those checks; and
  • what you can expect from SureCert’s platform.

They apply only if you have been invited by an organisation to complete a background check or verification using the SureCert platform.

You are not entering into a commercial contract with SureCert.


2. Who is responsible for the checks

The organisation that invited you (the Organisation) is responsible for:

  • deciding which checks are required;
  • determining the lawful basis for carrying them out; and
  • deciding how the results are used.

SureCert provides the technology platform used to carry out those checks but does not decide why the checks are being performed or how the results are used.


3. Your role as a participant

By participating in a check, you acknowledge that:

  • you have been invited by the Organisation;
  • information may be collected directly from you and from third-party sources;
  • some checks rely on information provided by external data providers or public registries.

You are responsible for ensuring that information you provide is accurate and complete.


4. Nature and limitations of checks

Background checks and verifications:

  • are based on the information available at the time the check is performed;
  • may be limited by data availability, jurisdiction, or law; and
  • may not identify all relevant information.

SureCert does not guarantee that any check will be complete, current, or error-free.


5. Outcomes and decisions

The SureCert platform may display outcomes such as “completed”, “unable to verify”, or similar status indicators.

These outcomes are based on the underlying data returned by checks and do not represent a decision by SureCert.

All decisions based on the results are made by the Organisation, not by SureCert.


6. Data protection and privacy

The Organisation is the data controller for your personal data.

SureCert acts as a service provider processing information on the Organisation’s behalf.

Information about how personal data is processed, stored, and shared is set out in the SureCert Platform Privacy Notice, which you should read carefully.

If you wish to exercise data protection rights (such as access or correction), you should contact the Organisation in the first instance.


7. Criminal record and sensitive checks

Some checks may involve sensitive information, including criminal record information, depending on the Organisation’s requirements and the jurisdiction involved.

Such checks are carried out using third-party providers and are subject to applicable law and local availability.


8. International checks

If checks relate to countries outside the United Kingdom:

  • availability and scope may vary;
  • local laws may restrict what information can be obtained; and
  • results may differ from UK-based checks.

The Organisation is responsible for ensuring checks are lawful in the relevant jurisdiction.


9. Your responsibilities

You agree to:

  • provide information honestly and accurately;
  • follow instructions provided during the check process; and
  • not attempt to interfere with or misuse the platform.

10. Limitation of SureCert’s responsibility

To the extent permitted by law, SureCert is not responsible for:

  • decisions made by the Organisation based on check results;
  • inaccuracies originating from third-party data sources; or
  • delays or unavailability caused by external providers.

Nothing in these terms limits liability where doing so would be unlawful.


11. Changes to these Terms

These Terms apply to the check you are completing. Updated versions will apply to future invitations.


12. Governing law

These Client Participation Terms are governed by the laws of Northern Ireland.

Before continuing, you will be asked to confirm that you have read and understood these Client Participation Terms and the Platform Privacy Notice.


End of Client Participation Terms
